Abstract Description: How to Avoid FCC Enforcement Action and Ensure Future Regulatory Compliance. The FCC’s Enforcement Bureau is active and can impose significant fines for violations of FCC rules. In recent enforcement actions, the FCC requires companies to implement detailed and robust compliance plans that cover their own employees and third-party vendors, including appointing senior executives to serve as compliance officers, develop compliance manuals, develop internal operating procedures, implement annual compliance training, and file compliance reports with the FCC. Thus, it is imperative that all utility personnel involved in FCC-regulated activities – from wireless spectrum acquisition and operation to tower construction – understand the relevant FCC rules and that utilities have policies and procedures in place to ensure compliance. This session will provide an overview of FCC enforcement authority, recent FCC enforcement activity relevant to utilities, and provide general guidance on how to avoid violations and expensive and burdensome FCC enforcement action, as well as how to deal with the FCC in case you find yourself responding to FCC enforcement inquiry.
